What AI communications compliance actually means

AI communications compliance is the discipline of ensuring that AI-generated communications — across every channel and use case where AI acts on behalf of your organization — meet your legal, regulatory, contractual, and policy obligations before they reach their intended audience.

That definition contains several important distinctions.

First, it covers AI-generated communications, not AI systems generally. There is a separate and legitimate field of AI governance concerned with model-level oversight: bias audits, model inventories, data lineage, access controls. That work matters. But AI governance at the model level doesn't prevent a specific AI agent interaction from producing a policy-violating communication in a specific context. The output is the risk. The output needs to be governed.

Second, it is about compliance — the set of legal and regulatory obligations your organization has accepted — not about safety in the abstract sense. AI governance and AI safety are related but distinct. Compliance is concrete: specific rules, specific regulators, specific contracts, specific obligations. AI communications compliance is the application of that concrete compliance obligation to the output of AI systems.

Why existing compliance programs fall short

Most enterprises deploying AI today are operating under the assumption that some existing compliance mechanism covers the output. That assumption is wrong in three specific ways.

eCommunications surveillance

Smarsh, Global Relay, and comparable platforms are well-engineered solutions to the problem they were designed for: capturing, archiving, and scanning the communications of human employees at regulated firms. Applied to AI agents, they hit two structural problems.

Volume. A compliance team calibrated for human communication rates — even at a large financial firm — cannot meaningfully review AI-generated output at scale. An AI agent handling customer service interactions might produce 10,000 outputs per day. Review queues become unworkable. Sampling rates drop to levels that no longer satisfy regulatory obligations.

Timing. eCommunications surveillance is a post-send model. The communication has already reached its destination before any review is possible. For AI agents operating in regulated contexts, that's after the damage is done. Post-send surveillance documents violations. It doesn't prevent them.

AI output checkers

Tools that evaluate AI-generated content for quality or policy compliance run on the output side of the pipeline. They can flag a problematic response — but only after it's been generated, often after it's been sent. They also tend to operate on generic quality heuristics rather than your organization's specific policies, regulatory constraints, and organizational context. An output checker might catch hallucinated information. It won't know that a specific product claim is under regulatory review, or that a legal hold is in place covering a topic the agent just discussed.

Generic AI governance platforms

Enterprise AI governance platforms typically focus on model-level concerns: model registries, access controls, audit logs, bias monitoring. These are legitimate and necessary. But they don't govern what a model actually says at inference time in a specific context. The platform knows an AI agent exists. It doesn't prevent that agent from producing a communication that violates your policies or your regulatory obligations in a specific customer interaction at 2pm on a Tuesday.

The gap is structural. None of these tools were designed to check a specific AI-generated output against your specific policies — before it sends.

The four exposure categories

AI communications compliance risk concentrates in four categories. Each is distinct, each has real financial consequences, and each requires deliberate governance.

The regulatory category gets the most attention, partly because it comes with fines and enforcement actions. In 2025, FINRA brought 12 enforcement actions for misleading communications, generating $6.5 million in fines — and communications violations appeared in the agency's top five enforcement categories for the first time in five years. That trend is running concurrent with AI agent deployments at financial services firms that most compliance programs haven't yet governed.

But the contractual and litigation hold categories carry real financial exposure too, and they're less visible because they surface through deals and litigation, not enforcement actions. An AI agent that makes an unauthorized commercial commitment creates a liability the company didn't budget for and may not discover until a deal closes. The pre-send vs. post-send gap

The single most important concept in AI communications compliance is the distinction between pre-send enforcement and post-send surveillance. Timing determines whether a program prevents violations or merely documents them.

Post-send surveillance — the dominant model in most enterprise compliance programs — operates after a communication has been sent and received. The communication is archived, scanned, anomalies are flagged, a compliance analyst reviews flagged items, and violations are escalated if confirmed. By the time that chain completes, the email is in the client's inbox. The contract language is in an executed agreement. The unauthorized disclosure has occurred.

Pre-send enforcement intervenes before a communication leaves the sender's control. The check happens at composition time — before the message sends, before the document is shared, before the agent generates a response — and the result surfaces before any external party sees the content. Violations are caught and corrected before they happen.

Post-send surveillance tells you about violations that happened. Pre-send enforcement prevents violations from happening. For AI agents operating at scale, only one of those models is adequate.

The timing difference is more consequential than it first appears. A regulatory violation doesn't begin when a regulator discovers it — it begins when the violating communication is sent. A contractual commitment is made when the agent's output reaches the counterparty. A litigation hold breach occurs when hold-covered information is disseminated. In all three cases, post-send detection confirms the violation. It doesn't undo it.

For AI agents specifically, post-send surveillance fails at the basic operational challenge. An agent handling customer communications generates output at a rate no human review queue can keep up with. The case for pre-send over post-send enforcement goes beyond principle — it's the only operationally viable model for AI-scale communications volume.

Pre-send enforcement for AI agents means pre-generation policy enforcement: the relevant policy context is injected into the agent's context window before it generates output. The agent produces compliant output by construction because it has what it needs to know what it shouldn't say.

What an AI communications compliance program looks like

Building an AI communications compliance program is primarily an architecture question. The policy documents most organizations have — a White & Case 2025 survey found that 63 percent of organizations have an AI use policy as a document — are necessary but insufficient. A document can't check an agent's output at inference time.

Effective AI communications compliance requires three layers operating together.

These three layers work together to produce what matters: an agent that, at inference time, has full awareness of the applicable policies, the current organizational context, and the state of the conversation — before it generates any output.

The policy intelligence layer is where most organizations start. Converting passive policy documents into a structured, queryable registry is nontrivial work. But it's the only path to enforcement that runs at communication speed. A policy that lives in a PDF cannot be checked against an AI output in under a second. A structured policy object can.

The tenant context layer is where compliance programs most often underinvest. A legal hold in place for six months is useless for governing an AI agent if the agent's context was assembled at deployment and hasn't been updated. Active litigation, regulatory inquiry, approved claims lists — these change. The governance layer needs to track them in real time. This is what treating policy as infrastructure means in practice: policy objects that are live-updated and machine-accessible, not documents that sit in a drive and hope someone reads them.

Conversational context is the layer that becomes critical as agents handle multi-turn engagements. An agent that correctly declines to make a specific commitment in one turn might still build on prior conversation context in a way that creates the same exposure indirectly. Tracking what has been said, what has been declined, and what constraints are in force across a full engagement is a governance requirement for agents operating in complex commercial contexts.

Internal knowledge tools deserve specific attention because they're often treated as low-risk. They're internal — who cares? A practical sequence:

  1. Inventory your AI communications surface area. Map every workflow where AI is generating or assisting communications that leave the organization or cross internal privilege or hold boundaries.   2. Classify by risk tier. Customer-facing agents in regulated industries are the highest priority. Internal knowledge tools with access to hold-covered or privileged material are second. AI-assisted drafting that produces externally-facing documents is third. Low-risk administrative automation can wait.
  3. Start with policy intelligence for your highest-risk channel. Build a structured policy registry for the regulatory and internal constraints governing that channel. This is the foundation everything else depends on — don't try to shortcut it with documents.
  4. Add tenant context for active risks. For the same channel, identify the current organizational context facts that matter: active litigation, legal holds, pending regulatory matters, approved and prohibited claims. Build the process for keeping those current.
  5. Implement pre-generation enforcement at inference time. Wire the policy intelligence and tenant context into the agent's inference pipeline. Test systematically against known compliance edge cases for that channel before going live.
  6. Extend to adjacent channels. Once the model is working for your highest-risk channel, extension to adjacent channels is primarily a policy and context configuration effort — not a re-architecture.
  7. Establish governance review cadence. Set a regular schedule for reviewing and updating the policy registry, tenant context, and enforcement rules as your regulatory environment and organizational situation evolve. A governance program that goes stale is a governance program that fails silently.

The instinct to solve this comprehensively before deploying AI agents is understandable but often counterproductive — AI deployment won't wait for a complete governance program to exist. A focused governance layer on your highest-risk channel, built correctly, is more valuable than a broad program built hastily. Start there. Extend with discipline.
